PUBLIC HEARING – Validity Challenge to the Zoning Ordinance and/or Zoning Map


TAKE NOTICE, that on May 9, 2017, at 6:00 pm, at the Bloomsburg Fire Department, 911 Market Street, Bloomsburg, Pennsylvania, the Town Council of the Town of Bloomsburg will conduct a public hearing pursuant to the Municipalities Planning Code on a validity challenge to the Zoning Ordinance and/or the Zoning Map of the Town of Bloomsburg filed by Bloomsburg Town Center, LLC. Bloomsburg Town Center, LLC claims that the Town of Bloomsburg Zoning Ordinance is exclusionary and requests to use the property located at 595 West Eleventh Street, Bloomsburg, Pennsylvania, which is located in the Industrial Park Zoning District of the Town of Bloomsburg, for the uses set forth in the validity challenge as follows:

1. Assisted Living, Personal Care, Long Term Care, and Rehabilitation Housing and Facilities;
2. Business, Professional, and Governmental Offices related to or supporting of all Health and Human Service functions and permitted uses;
3. Adult Day and 24-hour Care Programs and Facilities;
4. Alcohol and Substance Abuse Addiction Treatment and Recovery Programs, Housing, and Services;
5. Behavioral Health, Wellness, and Substance Abuse Treatment Services;
6. Community, Group, Transitional, Homeless Shelter, Sober, and Dormitory Living Facilities;
7. Educational and Conference and training and vocational Facilities;
8. Financial Services, including banks drive through, and ATM’s or drive-up businesses and facilities including Pharmacies;
9. Food Banks, Pantries, Soup Kitchens, Food, Clothing, Household Furnishings, donations, sales, and giveaways;
10. Gyms, Fitness, and Recreational Uses and Facilities;
11. Business identification signs;
12. Outpatient and Inpatient Medical, Dental, Mental Health, Medical Offices, Hospital, and Medical Testing and Laboratories Facilities;
13. Retail Stores, Personal Service Shops, Furniture Upholstering and Repair; and,
14. Single-unit Dwellings, Two-unit Dwellings, and Multiple-unit Dwellings.

Copies of the request for curative amendment, including plans, explanatory material, or proposed amendment may be examined by the public at the Bloomsburg Town Hall, 301 East Second Street, Bloomsburg, Pennsylvania during regular business hours from 8:00 am until 4:30 pm, Monday through Friday.
